These terms govern https://www.dfacto.ai and the software published under it by Deepak Marathe, sole proprietor, India.
What is sold
dfacto.ai publishes desktop and browser software. Each product is licensed to you, not sold outright: you receive a non-exclusive, non-transferable right to use it on the number of devices stated at purchase. Free tiers remain available indefinitely and are not time-limited.
Who you buy from
Purchases are sold by our merchant of record, who is the seller of record for the transaction, issues your invoice, and handles payment and any applicable taxes. Your payment contract is with them; the software licence is granted by us.
Delivery
Delivery is immediate and electronic. Browser extensions install from their store; desktop applications are downloaded. Paid licences arrive by email as a key you enter in the application. There is no physical product and no shipping.
Subscriptions and renewal
Subscriptions renew automatically until cancelled. You may cancel at any time through the link in your receipt or by emailing us; access continues to the end of the paid period. Prices may change for future renewal periods with at least 30 days’ notice.
“Lifetime” means the lifetime of the product, not of the purchaser. If a product is discontinued, lifetime licences stop receiving updates; the last released version continues to work for as long as the platform supports it.
Refunds
Fourteen days, no questions asked, on every paid product. See the refund policy.
Acceptable use
- Do not circumvent, patch, or redistribute the licensing mechanism.
- Do not resell or sublicense licence keys.
- Do not use the software in violation of applicable law.
- Do not misrepresent the software as your own.
Warranty and liability
The software is provided “as is”, without warranty of any kind. To the maximum extent permitted by law, our total liability is limited to the amount you paid in the preceding twelve months. Nothing here limits liability that cannot be limited under applicable law, including your statutory consumer rights.
Termination
We may terminate a licence for breach of these terms, in which case you may request a pro-rata refund of any unused subscription period.
Changes
We may update these terms; the date above changes when we do. Continued use after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of India, without regard to conflict of law rules.
